PREAMBLE
This Volunteer Waiver, Release, Assumption of Risk and Indemnification Agreement (“Agreement”) is entered into between TINNE HOLLY LARENAS FOUNDATION INC. (“Foundation”) and the undersigned volunteer (“Volunteer”).
By completing the volunteer application and electronically acknowledging this Agreement, Volunteer voluntarily agrees to all terms herein. Volunteer acknowledges that this Agreement is a material condition of being permitted to volunteer with the Foundation.
Volunteers may serve in varied settings, including concession stands, stadiums, arenas, sports venues, indoor and outdoor events, community fundraisers, festivals, public spaces, private facilities, community cleanups, youth programs, senior programs, administrative activities, event-support activities, and any other location or activity for which the Foundation obtains or performs a volunteer or fundraising contract.
This Agreement is intended to be interpreted as broadly as permitted by applicable law. However, no contract can lawfully waive liability for conduct that applicable law does not permit to be waived, including certain acts of gross negligence, willful misconduct, intentional wrongdoing, or other non-waivable claims.
ACKNOWLEDGMENT OF VOLUNTEER STATUS
Volunteer acknowledges and agrees that:
- Volunteer serves strictly as a volunteer and without wages, salary, compensation, employment benefits, or an expectation of employment.
- Volunteer is not an employee, agent, partner, joint venturer, representative, or independent contractor of the Foundation unless a separate written agreement expressly states otherwise.
- Volunteer has no authority to bind the Foundation, sign contracts on its behalf, incur expenses in its name, make commitments for the Foundation, or represent that Volunteer has authority beyond the specific assignment provided.
- Volunteer understands that the Foundation does not provide workers’ compensation coverage for volunteers and that Volunteer is not entitled to workers’ compensation benefits solely because of volunteer service.
- Volunteer is responsible for personal transportation, personal insurance, personal medical coverage, personal taxes, and personal expenses unless the Foundation expressly agrees otherwise in writing.
- Reimbursement of an approved expense does not create an employment relationship or other compensated status.
- Volunteer may be refused, dismissed, suspended, reassigned, or removed from any activity at the Foundation’s discretion.
SECTION 1: ACKNOWLEDGMENT OF RISKS AND CONDITIONS
Volunteer acknowledges and understands that volunteer activities may involve inherent, foreseeable, and unforeseeable risks, dangers, hazards, and conditions, including but not limited to:
- Physical exertion, lifting, carrying, reaching, bending, kneeling, climbing, standing for long periods, walking, running, and repetitive movement;
- Slipping, tripping, falling, falling objects, falling from a height, and impacts with floors, walls, fixtures, furniture, equipment, or structures;
- Indoor and outdoor conditions, including extreme heat, cold, rain, wind, storms, lightning, flooding, snow, ice, severe weather, natural disasters, and other Acts of God or force majeure events;
- Exposure to sun, insects, animals, plants, pollen, dust, smoke, fumes, chemicals, cleaning products, and environmental contaminants;
- Exposure to illness, communicable diseases, viruses, bacteria, allergens, foodborne illness, and other health conditions;
- Food preparation, food handling, cooking, serving, hot surfaces, steam, grease, oil, sharp utensils, cooking appliances, spills, burns, cross-contamination, and food or allergen exposure at concession stands and fundraising events;
- Interaction with large crowds, members of the public, attendees, patrons, venue personnel, contractors, partner organizations, and other volunteers;
- Accidental or incidental physical contact, bumps, jostling, pushing, collisions, crowd surges, crowd movement, and being struck by another person;
- Crowd-related incidents, including altercations, fights, disorderly conduct, unruly behavior, violence, threats, criminal conduct, and other acts or omissions of third parties;
- Use, misuse, handling, loading, unloading, storage, or transportation of equipment, machinery, concession equipment, cooking appliances, utensils, tools, supplies, merchandise, food, beverages, vehicles, and other property;
- Concession stand hazards, including hot liquids, hot food, cooking surfaces, electrical equipment, slippery floors, sharp objects, heavy items, cash-area congestion, and customer interactions;
- Stadium, arena, event, festival, school, park, warehouse, office, parking lot, sidewalk, roadway, construction, maintenance, or facility hazards;
- Uneven pavement, potholes, wet floors, spills, debris, steps, ramps, railings, doors, gates, bleachers, seating areas, restricted areas, and inadequate or changing lighting;

- Accidents involving personal vehicles, rental vehicles, Foundation vehicles, venue vehicles, delivery vehicles, contractors, or third parties;
- Damage to, loss of, or theft of personal property, money, clothing, phones, electronic devices, vehicles, equipment, or other belongings;
- Verbal disputes, harassment, bullying, intimidation, discrimination, threats, physical fights, assault, theft, vandalism, or criminal activity by other persons;
- Emotional distress, embarrassment, anxiety, fear, stress, or other psychological effects;
- Injury, illness, disability, aggravation of a pre-existing condition, hospitalization, permanent impairment, or death;
- Risks arising from inaccurate, incomplete, delayed, or misunderstood instructions;
- Risks arising from conditions that are unknown, hidden, changed, or not reasonably observable;
- Any and all other risks not specifically listed in this Agreement.
Volunteer voluntarily and knowingly assumes all risks associated with Volunteer’s service, whether known or unknown, foreseeable or unforeseeable, listed or unlisted, and accepts responsibility for any injury, damage, illness, loss, expense, or harm that may occur, except to the extent a claim cannot lawfully be waived.
Volunteer agrees to stop participating and promptly notify Foundation staff of any unsafe condition, injury, illness, hazard, conflict, or situation Volunteer believes may create a risk.
SECTION 2: RELEASE AND WAIVER OF LIABILITY
In consideration of being permitted to volunteer with the Foundation, Volunteer, on behalf of Volunteer and Volunteer’s heirs, executors, administrators, successors, and assigns:
HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE TINNE HOLLY LARENAS FOUNDATION INC., its founders, officers, directors, board members, employees, agents, representatives, volunteers, insurers, contractors, affiliated organizations, partner organizations, sponsors, donors, venue owners, venue operators, event organizers, facility owners, facility operators, and their respective employees, agents, representatives, officers, directors, and contractors (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, damages, losses, liabilities, judgments, expenses, costs, and attorneys’ fees arising out of or in any way related to Volunteer’s recruitment, application, orientation, training, transportation, presence, service, participation, or removal from any Foundation activity.
This release includes claims arising from or related to:
- Personal injury, illness, disability, death, or emotional distress;
- Property damage, property loss, or theft;
- Ordinary negligence or alleged negligent acts or omissions of any Released Party;
- Premises conditions, equipment, food, transportation, weather, facility conditions, or event conditions;
- Acts or omissions of other volunteers, attendees, patrons, venue personnel, contractors, partner organizations, or members of the public;
- Fights, altercations, crowd incidents, accidental contact, collisions, theft, criminal conduct, or disorderly conduct by third parties;
- Medical treatment, emergency transportation, hospitalization, or medical expenses;
- Any claim arising from Volunteer’s failure to follow instructions, rules, policies, safety requirements, or applicable law.
This release applies to claims that are known or unknown, suspected or unsuspected, fixed or contingent, accrued or unaccrued, and existing now or arising later.
This release does not release a claim to the extent that applicable law prohibits the release of that claim, including claims based on the gross negligence, willful misconduct, intentional wrongdoing, or other non-waivable conduct of the Foundation.
Volunteer understands that this is a broad and substantial release of legal rights, including the right to bring an ordinary negligence claim against the Released Parties where such waiver is legally enforceable.
SECTION 3: INDEMNIFICATION, DEFENSE, AND HOLD HARMLESS
To the maximum extent permitted by applicable law, Volunteer agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, damages, injuries, losses, liabilities, judgments, fines, penalties, costs, and expenses, including reasonable attorneys’ fees and litigation expenses, arising out of or related to:
- Volunteer’s acts, omissions, negligence, recklessness, misconduct, or intentional conduct;
- Volunteer’s violation of any law, regulation, venue rule, Foundation policy, or instruction;
- Volunteer’s breach of this Agreement or the Foundation’s Code of Conduct;
- Volunteer’s misuse of equipment, property, money, food, supplies, vehicles, or facilities;
- Volunteer’s conduct toward another volunteer, participant, minor, vulnerable person, attendee, patron, staff member, venue representative, or member of the public;
- Any claim brought by a third party arising from Volunteer’s participation or conduct;
- Any representation, promise, commitment, solicitation, transaction, or agreement made by Volunteer without Foundation authorization;
- Any damage to property caused by Volunteer’s negligence, recklessness, misconduct, or intentional act.
Volunteer’s indemnification obligations do not require Volunteer to indemnify a Released Party for liability that applicable law prohibits Volunteer from assuming.
SECTION 4: THIRD-PARTY ACTS AND FORCE MAJEURE
Volunteer acknowledges that the Foundation does not own, operate, control, supervise, or insure every venue, stadium, facility, event, parking area, roadway, contractor, partner organization, attendee, patron, or third party involved in volunteer activities.
The Foundation cannot and does not control the actions, omissions, negligence, recklessness, criminal conduct, or intentional conduct of third parties.
To the maximum extent permitted by law, the Foundation shall not be responsible or liable for injury, damage, loss, or harm caused by or arising from:
- Other volunteers;
- Venue staff or contractors;
- Event attendees, patrons, customers, or members of the public;
- Fights, altercations, physical contact, crowd movement, crowd surges, or disorderly conduct;
- Theft, assault, vandalism, criminal conduct, or other intentional conduct by third parties;
- Venue conditions, facility conditions, equipment, food, or property controlled by others;
- Acts or omissions of partner organizations, sponsors, contractors, transportation providers, or event operators.
The Foundation shall not be liable for any failure, delay, cancellation, interruption, modification, or inability to perform caused by events beyond its reasonable control, including acts of God, natural disasters, severe weather, storms, lightning, fire, flood, earthquake, pandemic, epidemic, public-health emergency, power outage, communications failure, transportation interruption, labor dispute, governmental action, civil unrest, venue closure, security threat, event cancellation, or other force majeure event.
SECTION 5: MEDICAL EMERGENCY CONSENT AND AUTHORIZATION
Volunteer authorizes the Foundation and its representatives to obtain, arrange, or request emergency medical evaluation, first aid, emergency transportation, or medical treatment for Volunteer if Volunteer is injured, becomes ill, is unable to consent, or cannot be reached.
Volunteer understands and agrees that:
- The Foundation does not provide medical insurance or medical coverage to volunteers.
- The Foundation is not a medical provider and does not guarantee the availability, quality, outcome, or adequacy of emergency treatment.
- Volunteer is solely responsible for medical bills, emergency transportation, hospitalization, medication, treatment, rehabilitation, and other medical expenses.
- The Foundation is not responsible for the acts or omissions of emergency responders, hospitals, physicians, nurses, medical providers, transportation providers, or other third parties.
- Volunteer should provide accurate emergency-contact information and disclose relevant allergies, medical conditions, physical limitations, medications, or accommodations needed for safe participation.
- Volunteer remains responsible for carrying and administering personal medication, including epinephrine auto-injectors, inhalers, insulin, or other prescribed medication, unless applicable law or a separate written agreement provides otherwise.
SECTION 6: CODE OF CONDUCT, CONFIDENTIALITY, AND COMPLIANCE
Volunteer agrees to comply with this Agreement, the Foundation’s Code of Conduct, all applicable program policies, all Foundation instructions, all venue rules, and all federal, state, and local laws.
Volunteer shall:
- Treat all persons with dignity, courtesy, fairness, and respect;
- Refrain from discrimination based on race, color, religion, sex, pregnancy, gender identity, sexual orientation, national origin, age, disability, veteran status, or any other legally protected characteristic;
- Refrain from bullying, cyberbullying, harassment, intimidation, hazing, stalking, threats, coercion, retaliation, or abusive conduct;
- Refrain from physical violence, fighting, assault, threats of violence, or conduct that creates a hostile or unsafe environment;
- Refrain from bribery, kickbacks, offering or accepting improper payments, secret commissions, unauthorized favors, or anything of value intended to improperly influence a decision;
- Refrain from theft, stealing, fraud, embezzlement, misappropriation, unauthorized taking, unauthorized use, or concealment of property, money, goods, supplies, equipment, merchandise, food, or other items belonging to the Foundation, a venue, a partner organization, an attendee, a patron, or any third party;
- Refrain from dishonest, fraudulent, deceptive, misleading, or falsified conduct;
- Refrain from soliciting gratuities, tips, donations, money, gifts, or personal benefits from attendees, patrons, participants, customers, or the public;
- Refrain from using alcohol, illegal drugs, controlled substances without lawful authorization, weapons, or other dangerous items while volunteering;
- Refrain from smoking, vaping, or using tobacco products where prohibited by law, venue policy, or Foundation policy;
- Follow all instructions of Foundation staff, supervisors, site managers, venue personnel, and authorized event representatives;
- Wear required identification, clothing, personal protective equipment, or safety equipment;
- Remain in assigned areas and refrain from entering restricted areas;
- Avoid unauthorized photography, recording, publication, livestreaming, or social-media activity involving participants, minors, vulnerable persons, private information, or restricted areas;
- Avoid making unauthorized public statements or representing personal opinions as Foundation positions;
- Safeguard confidential, personal, financial, medical, donor, participant, staff, volunteer, partner, and organizational information;
- Not copy, retain, transmit, post, sell, disclose, or use confidential information except as authorized;
- Promptly report safety concerns, incidents, injuries, illnesses, threats, suspected abuse, neglect, exploitation, discrimination, harassment, bullying, theft, fraud, bribery, violence, or policy violations to Foundation staff and, when required, the appropriate authorities;
- Cooperate truthfully with incident reviews and investigations without conducting an unauthorized investigation;
- Preserve relevant documents, photographs, messages, correspondence, or other materials relating to a report or incident;
- Not retaliate against a person who makes a good-faith report or participates in a review.
Violations may result in immediate removal, suspension, termination of volunteer privileges, referral to law enforcement, reporting to appropriate agencies, or other action permitted by law.
SECTION 7: TIPS AND GRATUITIES POLICY
Volunteer acknowledges that, as a general practice, Foundation volunteer roles do not involve handling, collecting, accounting for, or controlling money.
If a Volunteer is offered or receives a tip, gratuity, or voluntary gift from an attendee, patron, customer, or member of the public in connection with Volunteer’s service:
- The Foundation permits Volunteer to retain the tip for Volunteer’s personal use.
- The Foundation prefers, but does not require, that Volunteer voluntarily donate tips received back to the Foundation to support its charitable mission.
- Volunteer may not demand, pressure, threaten, coerce, solicit, or imply an entitlement to a tip or gratuity.
- Volunteer may not misrepresent that a tip is required, that a tip belongs to the Foundation, or that a tip will benefit a particular person or program unless authorized.
- The Foundation does not track, monitor, collect, possess, account for, distribute, or enforce any obligation concerning tips received by Volunteer.
- The Foundation accepts no responsibility or liability for tips received, retained, donated, lost, stolen, disputed, or misreported by Volunteer.
- Volunteer is solely responsible for determining whether tips constitute taxable income and for reporting tips or other income to the appropriate tax authorities as required by law.
- The Foundation assumes no responsibility for Volunteer’s tax obligations, reporting obligations, or consequences relating to tips or gratuities.
SECTION 8: MINOR VOLUNTEERS — EXTRA PROTECTIONS
The Foundation may permit individuals under eighteen years of age (“Minor Volunteers”) to participate in certain volunteer activities. Participation by a Minor Volunteer is subject to the following requirements:
8.1 Parent or Guardian Consent
No Minor Volunteer may participate unless the Foundation has received prior written or electronically acknowledged consent from the Minor Volunteer’s parent or legal guardian.
The parent or legal guardian must review and acknowledge this Agreement and any applicable minor-consent, medical, media, transportation, or program-specific form on behalf of the Minor Volunteer.
A Minor Volunteer’s electronic acknowledgment does not replace the required parent or legal guardian consent.
8.2 No Rides Without Consent
No volunteer, staff member, contractor, venue representative, or adult associated with the Foundation may transport a Minor Volunteer in any personal vehicle, rental vehicle, Foundation-owned vehicle, rideshare vehicle, or other vehicle without prior written or electronically acknowledged consent from the Minor Volunteer’s parent or legal guardian.
Volunteers shall not offer, solicit, arrange, or provide transportation to a Minor Volunteer unless:
- Parent or guardian consent is documented;
- The transportation is authorized under the applicable activity plan;
- The driver is legally licensed and properly insured;
- The vehicle is legally registered and safe;
- The transportation follows Foundation and venue requirements.
The Foundation strongly discourages informal transportation of minors. Transportation arranged outside the Foundation’s documented process is unauthorized and undertaken at the responsible person’s own risk.
Nothing in this Agreement requires the Foundation to provide transportation or assumes that the Foundation is responsible for transportation arranged by a Volunteer, parent, guardian, venue, group, or third party.
8.3 No Unsupervised One-on-One Contact
No adult volunteer shall be alone with a Minor Volunteer in any location, including rooms, vehicles, restrooms, hallways, storage areas, offices, parking lots, or outdoor spaces, outside the presence of another authorized adult or program staff member.
The Foundation’s two-adult rule shall apply whenever reasonably practicable and in accordance with applicable law and Foundation policy.
8.4 Background Checks and Screening
Adult volunteers who will work with or around Minor Volunteers may be required to complete criminal-background screening, sex-offender-registry screening, child-abuse-registry screening, reference checks, training, or other screening required by law, venue rules, partner requirements, insurers, or Foundation policy.
The Foundation may deny, suspend, or terminate access to minors based on screening results, incomplete screening, refusal to consent, or other safety concerns.
8.5 No Personal Contact Information Exchange
Volunteers shall not share personal phone numbers, email addresses, social-media handles, home addresses, schedules, employment information, or other personal contact information with Minor Volunteers.
Volunteers shall not request or accept such information from Minor Volunteers except through an official, approved, and supervised Foundation program channel.
8.6 Prohibited Contact Outside Activities
Volunteers shall not initiate, solicit, arrange, or maintain contact with Minor Volunteers outside official, supervised Foundation activities, including by personal text message, phone call, email, social media, direct message, gaming platform, personal visit, or unsupervised in-person meeting.
Any attempted contact outside approved channels must be promptly reported to Foundation staff.
8.7 Gifts and Financial Transactions
Volunteers shall not provide, request, promise, or accept money, loans, significant gifts, gift cards, financial assistance, employment opportunities, or other valuable benefits involving a Minor Volunteer without prior written Foundation approval and parent or guardian consent where applicable.
8.8 Medical Consent for Minors
The parent or legal guardian authorizes the Foundation and its representatives to seek emergency medical evaluation or treatment for a Minor Volunteer if the parent or guardian cannot be reached.
The parent or legal guardian assumes responsibility for medical expenses, transportation costs, hospitalization costs, and other expenses arising from care provided to the Minor Volunteer.
8.9 Media and Photography Consent for Minors
No photograph, video, recording, or image of a Minor Volunteer may knowingly be taken, used, published, distributed, or posted by the Foundation for promotional, fundraising, website, social-media, or documentation purposes without prior written consent from the parent or legal guardian.
8.10 Reporting of Concerns
Any volunteer who witnesses, receives information about, or reasonably suspects abuse, neglect, exploitation, trafficking, grooming, harassment, bullying, discrimination, violence, self-harm risk, or another safety concern involving a Minor Volunteer shall immediately report the concern to Foundation staff and to the appropriate authorities as required by applicable law.
The Foundation requires volunteers to report suspected abuse or neglect involving minors in accordance with applicable law and Foundation policy. Volunteers shall not investigate, interrogate, promise confidentiality, or delay reporting while attempting to verify the concern.
SECTION 9: GROUP VOLUNTEER PARTICIPATION
This Section applies when volunteers participate as part of a group, team, class, club, organization, employer, church, school, civic association, family, corporate team, or other collective unit (“Group”).
9.1 Designated Group Leader
Each Group shall designate a Group Leader as the primary point of contact with the Foundation.
The Group Leader is responsible for communicating Foundation policies, rules, instructions, schedules, safety requirements, dress requirements, and conduct expectations to all Group members.
9.2 Group Leader Certifications
The Group Leader represents and certifies that:
- Every Group member has received an opportunity to review and acknowledge this Agreement and the Foundation’s Code of Conduct;
- Appropriate parent or guardian consent has been obtained for every Minor Volunteer;
- The identity and eligibility of each Group member have been verified to the extent reasonably practicable;
- The Group has disclosed any relevant accommodations, restrictions, allergies, or safety information;
- The Group will provide adequate adult supervision for Minor Volunteers;
- The Group will comply with all Foundation, venue, partner, and applicable legal requirements;
- The Group will promptly report all incidents, injuries, hazards, policy violations, and safety concerns.
A Group Leader’s certification does not eliminate the requirement that each individual Volunteer acknowledge this Agreement when required by the Foundation.
9.3 Group Responsibility and Indemnification
To the maximum extent permitted by law, the Group, its organizers, sponsoring organizations, employers, schools, churches, clubs, associations, and other responsible entities agree to be responsible for the conduct of their participating members and to indemnify and hold harmless the Released Parties from claims, damages, losses, or liabilities arising from the acts, omissions, negligence, recklessness, misconduct, or violations of any Group member.
Where required by the Foundation, the Group or sponsoring organization must execute a separate written group participation, insurance, indemnification, or facility agreement before participation.
9.4 Venue and Activity Compliance
The Group and all Group members shall comply with:
- Foundation instructions;
- Venue and facility rules;
- Safety requirements;
- Food-handling requirements;
- Parking and transportation rules;
- Dress and identification requirements;
- Applicable federal, state, and local laws;
- All requirements communicated by event operators, partners, contractors, or venue representatives.
9.5 Group Supervision
The Group is responsible for providing adequate supervision of its members, including Minor Volunteers, unless the Foundation expressly agrees in writing to provide supervision.
The Foundation does not assume parental, custodial, educational, or guardianship responsibility for any Group member or Minor Volunteer.
9.6 No Group Solicitation
Groups shall not use Foundation activities, venues, facilities, mailing lists, participant information, or events to:
- Solicit members;
- Distribute unauthorized materials;
- Promote outside causes;
- Advertise personal businesses;
- Recruit for another organization;
- Conduct fundraising for the Group’s own benefit;
- Collect money without authorization;
- Promote political candidates or campaigns;
- Promote products or services;
without the Foundation’s prior written approval.
SECTION 10: MEDIA AND PHOTOGRAPHY RELEASE
Unless Volunteer explicitly opts out through the designated Foundation process, Volunteer grants the Foundation and its authorized representatives permission to photograph, videotape, audio-record, or otherwise record Volunteer during Foundation activities.
Volunteer authorizes the Foundation to use, reproduce, edit, publish, display, distribute, and archive Volunteer’s name, likeness, image, voice, statements, and recorded participation for legitimate Foundation purposes, including:
- Program documentation;
- Educational materials;
- Website content;
- Social media;
- Newsletters;
- Reports;
- Donor communications;
- Grant materials;
- Public relations;
- Advertising;
- Promotional activities;
- Fundraising materials.
Volunteer releases the Released Parties from claims relating to authorized use of such photographs, recordings, videos, statements, or likenesses, including claims based on privacy, publicity, defamation, or emotional distress, except to the extent prohibited by law.
A Volunteer who does not consent to media use must opt out through the method designated by the Foundation. The Foundation will use reasonable efforts to honor a properly submitted opt-out but cannot guarantee that Volunteer will never be incidentally captured in crowd, public-event, venue, security, or third-party footage.
No Minor Volunteer may knowingly be used in Foundation promotional or public media without the prior written consent of the Minor Volunteer’s parent or legal guardian.
SECTION 11: PROPERTY, EQUIPMENT, AND PERSONAL BELONGINGS
Volunteer understands and agrees that:
- The Foundation is not responsible for loss, theft, destruction, or damage to Volunteer’s personal property, vehicle, money, clothing, phone, electronic device, equipment, or other belongings.
- Volunteer should not bring valuables to volunteer activities.
- Volunteer shall exercise reasonable care when using Foundation, venue, partner, sponsor, or third-party property.
- Volunteer shall use equipment only as instructed and only for authorized purposes.
- Volunteer shall promptly report damaged, missing, defective, unsafe, or malfunctioning property.
- Volunteer may be responsible for property damage caused by Volunteer’s negligence, recklessness, intentional misconduct, misuse, unauthorized use, or violation of instructions.
- Volunteer shall not remove, borrow, sell, transfer, conceal, alter, or use property without authorization.
- Money, merchandise, supplies, food, equipment, documents, credentials, keys, access cards, and other Foundation or venue property must be returned upon request or at the end of service.
SECTION 12: ADDITIONAL GENERAL PROTECTIONS
12.1 Venue and Facility Rules
Volunteer agrees to comply with all rules, regulations, policies, safety requirements, security requirements, and instructions of any venue, stadium, facility, event operator, partner organization, contractor, or property owner where Foundation activities occur.
Volunteer acknowledges that the Foundation may not control such venues or facilities and may not be responsible for conditions or conduct controlled by others.
12.2 Personal Vehicles and Transportation
If Volunteer uses a personal vehicle in connection with volunteer service:
- Volunteer must maintain a valid driver’s license;
- Volunteer must maintain legally required automobile insurance;

12.4 No Alcohol, Drugs, Smoking, or Impairment
Volunteers shall not consume alcohol, use illegal drugs, misuse prescription medication, report for service impaired, or possess illegal controlled substances while volunteering.
Volunteers shall not smoke, vape, or use tobacco products where prohibited by law, venue policy, or Foundation policy.

- Anti-discrimination and anti-harassment requirements;
- Privacy and confidentiality;
- Theft, fraud, bribery, and financial misconduct;
- Transportation and motor vehicles.
12.6 No Unauthorized Financial or Contractual Authority
Volunteer shall not:
- Receive, hold, deposit, spend, transfer, or distribute Foundation funds without authorization;
- Sign contracts or agreements on behalf of the Foundation;

- Promise payment, reimbursement, employment, services, donations, or benefits;
- Accept donations on behalf of the Foundation except under approved procedures;

Volunteer shall refer media inquiries, legal inquiries, complaints, donation questions, and partnership requests to the Foundation’s authorized representative.
12.8 Reasonable Accommodations and Medical Disclosure
Volunteers with medical conditions, allergies, disabilities, dietary restrictions, or limitations relevant to their volunteer activities are encouraged to disclose appropriate information to Foundation staff so reasonable safety measures can be considered.
Volunteer is not required to disclose private medical information beyond what is reasonably necessary for safety, accommodation, or emergency planning.
Volunteer remains responsible for carrying and administering personal medications unless a separate written arrangement applies.
12.9 Incident Reporting and Cooperation
Volunteer must immediately report any injury, illness, accident, near miss, property damage, theft, threat, fight, altercation, abuse concern, harassment, bullying, discrimination, bribery, safety hazard, or policy violation to Foundation staff or the designated event supervisor.
Volunteer agrees to cooperate truthfully with any incident review and to preserve relevant evidence. Volunteer shall not make public statements, post accusations, or release confidential information concerning an incident without authorization, except where disclosure is required by law or necessary to obtain emergency assistance.
12.10 Right to Remove
The Foundation reserves the right, in its discretion and to the maximum extent permitted by law, to dismiss, remove, suspend, reassign, restrict, or prohibit any Volunteer from any activity, location, program, venue, or future volunteer opportunity, with or without cause and without liability.
The Foundation may take immediate action to protect safety, property, confidentiality, minors, vulnerable persons, participants, staff, volunteers, partners, or the public.
12.11 No Guarantee of Assignment or Hours
Volunteer understands that:
- Submission of an application does not guarantee acceptance;
- Acceptance does not guarantee a specific role, event, location, schedule, number of hours, or future assignment;
- The Foundation may change, cancel, postpone, restrict, or terminate any assignment;
- Volunteer is responsible for confirming the assignment and following the current instructions.
12.12 Limitation of Damages
To the maximum extent permitted by law, the Foundation’s aggregate liability to any Volunteer arising from volunteer service shall not exceed the amount, if any, actually paid by Volunteer directly to the Foundation for the specific activity giving rise to the claim.
To the maximum extent permitted by law, the Foundation shall not be liable for consequential, incidental, indirect, special, exemplary, or punitive damages, lost wages, lost opportunity, emotional-distress damages, loss of enjoyment, or loss of personal property.
This limitation does not apply to liability that cannot lawfully be limited or waived.
SECTION 13: GENERAL PROVISIONS
13.1 Governing Law
This Agreement shall be governed by and construed under the laws of the State of Georgia, without regard to conflict-of-law principles.
13.2 Venue
To the extent legally permissible, any dispute arising from this Agreement or Volunteer’s service shall be brought in a court of competent jurisdiction located in Cobb County, Georgia.
13.3 Severability
If any provision of this Agreement is held invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, if permitted.
If modification is not permitted, the provision shall be severed, and the remaining provisions shall continue in full force and effect.
The parties expressly intend that the remaining provisions and the protective purpose of this Agreement survive.
13.4 Entire Agreement
This Agreement constitutes the entire agreement between Volunteer and the Foundation concerning Volunteer’s general volunteer service and supersedes prior oral or written understandings concerning the same subject matter.
Program-specific agreements, minor-consent forms, group agreements, venue agreements, and other written policies may impose additional requirements. If a specific written agreement conflicts with this Agreement, the more protective or more specific provision shall apply to the extent legally permissible.
13.5 No Waiver
The Foundation’s failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.
13.6 Assignment and Third-Party Beneficiaries
The Foundation may assign or transfer its rights under this Agreement as permitted by law.
The Released Parties are intended third-party beneficiaries of the release, waiver, assumption-of-risk, indemnification, and limitation-of-liability provisions.

- Release and waiver;
- Assumption of risk;

- Confidentiality;
- Media authorization;
- Property obligations;
- Dispute provisions;
- Limitations of liability;
- No-solicitation provisions;

13.8 Construction
Volunteer acknowledges that:
- Volunteer has had the opportunity to read the entire Agreement;
- The headings are for convenience and do not limit the meaning of any provision;
- The Agreement shall not be construed against the Foundation solely because the Foundation prepared or presented it;
- Capitalized terms have the meanings provided in this Agreement;
- The singular includes the plural and vice versa where appropriate.
13.9 Opportunity to Ask Questions
Volunteer confirms that Volunteer has had an opportunity to ask questions about this Agreement and the volunteer activities and has either received answers or voluntarily chosen to proceed without additional questions.
SECTION 14: VOLUNTEER ACKNOWLEDGMENT AND AGREEMENT
